Update: Judge Dismisses Lawsuit Against Monsanto

Last week we posted about a potential landmark case being brought by the Organic Seed Growers and Trade Association (OSGATA) against Monsanto. On Saturday, news broke that the judge has dismissed the case as unsubstantiated. In statements from the plaintiff’s lawyers, they indicated they may exercise their right to appeal the decision, although no official appeals trial has begun. Regardless of the outcome, this case opens up a can of worms about the rights Monsanto has to sue for copyright infringement and if small, organic farmers have equal protection in our court system without making the same patent claims.
